Proposta para MEI prevê a criação de 3 milhões de empregos

O Projeto de Lei Complementar 252/20 de autoria do deputado Cel. Tadeu do PSL SP aumenta, de um para dois, o número de empregados que poderão ser contratados por Microempreendedor Individual (MEI) ou por empreendedor que exerça as atividades de industrialização, comercialização e prestação de serviços no âmbito rural. A proposta vem de encontro as solicitações que o Simpi vem fazendo há mais de 4 anos, e já tramita na Câmara dos Deputados onde altera a Lei Complementar 123.

Atualmente, a legislação define o MEI como o pequeno empresário individual com faturamento limitado a R$ 81 mil por ano, e que contrate, no máximo, um empregado. 

O MEI surgiu em 2008 com o objetivo de facilitar a formalização de pequenos negócios no País, sendo exigido dele o pagamento do Simples Nacional, cujo valor varia de acordo com a atividade desenvolvida. 

 

Reformas pela frente 

O Brasil carece de um processo político inteligente, de avançar com as reformas tributária, administrativa e do Estado, afirma Ricardo Rocha, professor de Finanças do Insper. Para ele, questões como a carga tributária, a dívida pública e direito de greve para funcionários nas esferas Federal e Estadual precisam ser resolvidas, sob pena de estagnar o país. 

No entanto, apesar destas apreensões, Rocha segue otimista. “Congresso e Governo saberão levar a frente estas reformas. Meu recado para o empresário: entre em 2021 preparado, reveja seu plano estratégico e esteja pronto para uma retomada do crescimento. Isso implica qualificação de mão de obra, contratar pessoas, equipamentos e aumentar o seu acesso a crédito”, orienta o professor. 

 

Nova resolução sobre Refis 

Recente decisão do STF definiu que optantes do Refis não podem ser excluídas sem prévia notificação em caso de inadimplência. O advogado Marcos Tavares Leite explica que “a mudança é importante porque muitas vezes a falha é nos registros de informações do sistema e não uma inadimplência. Com esta resolução, o poder público evitará processos judiciais e administrativos em decorrência de exclusões equivocadas”. 

 

Maior demanda por linhas de crédito de longo prazo 

De acordo com o Banco Central, as concessões de crédito tiveram pouca variação ao longo da pandemia. Foram mais favorecidas as linhas de prazo mais longo. Para o economista Roberto Luís Troster, “isso significa mais capital de giro, mais desconto de duplicatas e menos cheque especial. Houve também redução da inadimplência, em parte pela mudança na composição de crédito e parte pela a suspensão da cobrança do IOF”. Para ele, os indicadores mostram que ainda estamos no vermelho, mas na direção certa. 

 

Controle de ponto nas empresas 

A jornada de trabalho no Brasil é definida pela legislação e toda empresa com mais de vinte funcionários é obrigada a controlar marcação de ponto. “Apesar de não ser obrigatório este controle para empresas com menos de vinte funcionários, é importante no caso de uma eventual ação trabalhista”, orienta o advogado Marcos Bernardini. “O controle de ponto serve de instrumento para o juiz verificar a veracidade dos fatos”, salienta.
